Company Information
Mike's Cigars is one of the oldest Cigar distributors in the United States and has been serving cigar consumers in America and over the world since 1950. After 45 years of operating from its original location on Arthur Godfrey Road, in 1995 Mike's Cigars moved its operations to its current location where they still hold Postal Permit. Founded by Mike Mersel in 1950 decades before cigars became the domain of the common man. Mercel first sold socks and other goods from a pushcart in New York City on Manhattan’s Lower East Side in 1930s. To escape the northern winters, Mersel and Brother Albert “Ossie” relocated to South Florida where they began building their iconic cigar outfit in some unlikely places. For two years, the Mersel brothers sold hot dogs and peanuts in Flamingo Park. Next, they opened Mike’s News and Sundries on West Avenue and 17th Street in the early 1940s until they both were drafted to serve in World War II. After the war, the brothers reopened the business as Mike’s Cigars at 465 41st Street in Miami Beach, selling cigars at a time when few cigar shops existed. When Mike’s Cigars was opened, the Yankees were still the World Series champions and George Mikan was leading the Minneapolis Lakers to the championship of a young league called the National Basketball Association. Mike’s Cigars was selling mostly Cuban cigars until the U.S. embargo was imposed on Havana by President Kennedy in 1963 after Fidel Castro overtook Havana and nationalized the cigar industry in Cuba.
Expansion
Following the U.S. embargo Mike’s Cigars became a distributor for the General Cigar Corporation, the biggest domestic cigar manufacturer at the time. 1971 was a milestone year for Mike’s Cigars going from a customer base of walk-ins and wholesale, Mike Cigars started internationally. That same year Mike's cigars began licensing their cigar brands which includes today a wide selection including Licenciados, Bauza, 898 Collection, Chevere, Old Fashioned, and Mike’s 1950. After three decades Mike’s Cigars became a distributor for all cigar companies. Mike recruited Oscar Boruchin, a Cuban born immigrant, who was an executive with General Cigar Corporation. Boruchin grew the company from a local storefront selling patrons’ favorite smokes to a first-class wholesale operation.
Cigar Boom
By 1980, Miami Beach’s demographics began to change. Boruchin began to scale Mike's Cigars up with a coffee bar, and cigar accessories boutique featuring cigar humidors , as well as smaller cigars for women. Business had almost tripled, totaling over 500,000 customers and Boruchin’s son-in-law, Oded Ben-Arie was brought aboard to help with the growth. By 1993, Cigar Aficionado magazine rated Mike’s Cigars brand the Licenciados Toro a rating of 93. At that time this was the highest rating ever given to a non-Cuban cigar. From as early as 1995, and definitely since 1997 and in early 2000's, the cigar industry experienced unprecedented growth both in the U.S. and globally. Sales multiplied every year and most merchants were have trouble getting cigars. Mike’s Cigars connections with the major suppliers such as Arturo Fuente and General Cigar proved to be a great advantage.
New Location
The growing business dictated Mike’s Cigars move to its new and much larger building with a cigar shop storefront. The move enabled the company to add an extensive cigar accessories housed within a new boutique on the main floor, which show cased cutters, lighters, cigar cases, ashtrays and humidors imported from France, Italy, and Spain. Operating from the new landmark building, sales doubled with 25-30 million cigars sold per year. Wall Street proposed an IPO in 1998, Mike’s Cigars decided to stay private. This decision proved to be correct when anti-smoke trends years later forced other public U.S. cigar corporations to privatize. It was also the year Mike’s Cigars expanded into e-commerce.
Internet Website
In 2010 Oscar Boruchin retired and Oded Ben Arie became Mike’s Cigars President and CEO. Under the new management Mike's Cigars introduced it's third generation computer system and website, mikescigars.com, serving cigar lovers all over the world, shipping over a thousand packages a day in the U.S. and many more to all other parts of the globe. Mike’s Cigars Mega store is a magnet to consumers and with inventory of ten million cigars it is one of the largest facilities of its kind, worldwide. On the first floor, a full feature cigar bar was built with big screen TV’s accommodating group parties and individuals who would like to have their drinks and smoke a cigar in comfort. Many cigar bars came and went but Mike’s Cigars lives on as one of the largest cigars stores in America. Oscar Boruchin retired in 2010 and his Sr. Vice President and CEO, Oded Ben-Arie took the helm as president Chief Executive Officer of the company. Mr. Ben-Arie joined Mike’s Cigars in 1991 and has been serving the company as its Chief Executive Officer since 2004. Mr. Ben-Arie will continue leading the company as it completes the transition in the hi-tech Internet age. Mike’s Cigars is one of the big three independent cigar mega-stores in the United States with retail and wholesale Internet websites and mail-order catalog services, offering premium cigars from most of the cigar manufacturers worldwide.

Priority Mail
In most cases, the expected delivery date printed on your label or provided thur the USPS tracking system will reflect a delivery time of 1, 2, or 3 business days and is based on origin, destination, and drop-off time. The expected delivery date is not guaranteed.
Mike's Cigars Super Saver
Super Saver is the economical solution for non-time critical orders. Delivery will be made by UPS or USPS. Delivery addresses must be able to receive package from both carriers. Please note: if you need postal service delivery do not select Super Saver. All orders and/or items that receive Free Shipping will go freight free by Mike's Cigars Super Saver service.
Time in transit to all Florida destinations is not guaranteed. If your order is time sensitive please select Florida One Day service.
If your order qualifies for free shipping you need to actively select "Super Saver". The reason is that some customers that are ordering the same product do need it to arrive faster and therefore need to upgrade their service to 2nd day air, overnight, etc.
UPS Guaranteed Service
There will not be a refund if the shipment encountered either an emergency condition or adverse weather while in transit. As a result, this shipment does not qualify for a Guaranteed Service Refund.
Insurance
Customers have the option to purchase insurance for just a few dollars to cover any damage/loss to the package in-transit. On the payment page right under shipping, click YES on the insurance tab or decline if you would like to wave the coverage. We are not responsible for packages shipped without coverage.
Shipping Times
All orders are shipped ASAP. Please note that some orders are subject to delays for technical reasons.
Orders placed before 2pm Eastern time will ship the same day (except international orders). All others will ship the next business day. Business days are Monday through Friday, except holidays. Orders placed during the weekend (we are open Sat and Sun from 10am to 6pm) will be shipped on Monday (unless Monday is a holiday). Orders placed on a holiday will ship the next business day.
Alaska, Hawaii and Puerto Rico: freight charge varies.
REMEMBER: sometimes delays happen! If you need it by Friday and you ordered on Tuesday, Make your shipment 2nd day air or give us a phone call. "Better safe than sorry".
Ground shipments on Mondays may be delayed depending on weekend traffic. On some Mondays, after a very busy weekend, some delays are impossible to prevent.
Overnight orders placed by 4:00 PM EST will be shipped the same day.
Mike’s Cigars offers FREE SHIPPING on full cigar boxes with a minimum of 20 cigars within the contiguous United States for over 100 cigar brands (some restrictions may apply). Free Shipping may not be combined with other specials (such as e-mail specials) or promotions. Free gifts do not get free shipping, except lighters, cutters, single tins, and 5 packs. Please refer to our return policy.
Extra Charges
PO Boxes, APO/FPO addresses, and US Territories will ship via USPS and may incur additional delivery times and/or cost.
Some shipments going to remote locations will be charged an additional charge.
Heavy items may be subject to additional charges. You will see any applicable surcharges in your shopping cart/invoice along with the standard shipping fees.
All shipments from Mike's Cigars are FOB Origin Bay Harbor Islands, FL i.e. the risk of loss is on the Purchaser during transport and shipment to destination. Title to, and ownership of all goods passes from Seller to the Purchaser in Bay Harbor Island, Florida, and the Purchaser takes all responsibility for the shipment. By selecting the shipping method of transportation of the goods, Seller is providing a service to, and acting on behalf of Purchaser. By accepting this service from Seller, Purchaser is representing that they are acting in compliance with their local and state laws regarding the purchase, transportation, and delivery of the goods. The Purchaser represent that they are of lawful age and obtained all required permissions, paid all required fees, and are working through properly licensed intermediaries where required, as well as are legally entitled to take possession of the goods and entitled to take quantities ordered.
Retail Delivery Fee
Starting July 1, 2024, there will be a Retail Delivery Fee of 50 cents that applies to certain transactions involving retail delivery in Minnesota. (See Minnesota Statutes, Chapter 168E)
The fee applies to each transaction where charges for these items equal or exceed $100:

We ship cigars and cigar accessories to international consumers.
Please refer to your local tobacco import laws and restrictions before making an order.
Tobacco laws in other countries may restrict/prohibit export/import and we comply with all legal requirements including duties, taxes and other expenses – all of which must be paid by the customer.
All international customers who's orders are shipped outside of the United States via US Postal Service are responsible for their merchandise. All such purchases are FOB Miami and delivery is deemed complete once shipment arrives in the customer’s country. In the case that a package is lost, damaged or seized by customs, the customer assumes all responsibility.
We do not accept credit cards for shipments outside the US. Please contact us for payment information if your shipping address is not in the US.

Floor Standing Humidors are Nonreturnable Items. Any claims for defectiveness must be contacted directly through the manufacturer. This includes the item's warranty, replacement, or repair. Mike's Cigars is not responsible for any warranty, repair. Also Mike's Cigars do not have any liability to damages that results from deliveries. Mike's Cigars MAKES NO REPRESENTATIONS OR WARRANTIES for these items.
INTERNATIONAL SHIPMENTS

DISCLAIMERS
We reserve the right to cancel and fully refund the customer in any case of a typographical error or honest mistake that is clearly obvious that occurred on our web site. We will always try our best to accommodate any customer that was offended in such case in an amicable solution but sometimes we simply can't ship in this situation.
All gift certificates must be mailed back to us in order to be redeemed. You must make a purchase to redeem a gift certificate.
Brands that are promoted with a gift certificate for every box, the box must contain at least 20 cigars. Boxes with 19 cigars or less require a purchase of two boxes.
On brands with a discounted second box/bundle, the second box/bundle must be of equal or lesser value than the first box/bundle.
Application of gift certificate credit is subject to the "Gift Certificate Program" restrictions.
Samplers and free items - While we make every attempt to fill every order according to specified items, we sometimes have an "out of stock" situation. We reserve the right to substitute items with equal or better value items.
Samplers - In samplers that include cigars from different brands we reserve the right to replace a specific cigar with equal or higher value substitute.

RETURN POLICY
All returned items must be pre-approved with authorization by email. All returns must be in the original packaging and "new" condition as all merchandise shipped from our warehouse leaves here in perfect condition. All gift items must be included together with the returned items. If the gift item is not included in the return, it's value will be deducted from the credit for the returned item. In the unlikely event that you should doubt the quality of an item, you must notify us within 72 hours of receiving the merchandise to obtain a written return Authorization Number. Merchandise that will be returned or refused, will be subject to a restocking fee of up to 50% or $15 whichever is more. "Collector items", lighters or limited edition items are not returnable. Cigar Samplers, Double Stacks, Cigar Combos and Triple Deckers are not returnable. Once you have obtained an Authorization Number, you should mark it clearly on the package next to the address label. All returns will be reviewed and subjected to applicable restocking fee and shipping charge as all returns cannot be resold. Buyers remorse is not accepted for any returns. All Mike's Cigars orders are automatically processed by our secure merchant processor and sent for shipment as soon as possible. During this process, we incur irreversible fees as part of the shipping process, and as such, we are unfortunately unable to cancel orders free of charge. All orders that are cancelled before shipping has occurred, will be assessed a 7% cancellation fee (or a minimum of $10) before any credit is issued. An order will not be considered for cancellation after it has shipped. It will be treated as a return with all applicable fees.
ORDER CANCELATION
Orders that were already shipped cannot be canceled. Any order that was canceled by the customer or because the customer entered wrong information in the order form, will be subject to $19 cancelation fee regardless of the amount of the order.
FRESHNESS GUARANTEE
We take quality control very seriously. All the cigars we ship are shipped either in sealed boxes or, in case of single sticks or 5-packs, in properly sealed bags. Most cigars in our samplers are super-premium cigars and we do everything to guarantee freshness upon arrival.
All Mike's Cigars orders are shipped from our state-of-the-art climate controlled warehouse in Florida.
And all the cigars are hermetically packed in humidity sealed-in zip-loc with patented WATER-PILLOW packets inside the package to guarantee freshness.
With that said please let me add that shipping individual cigars to the pacific north-west by GROUND service is not recommended, especially in the summer By exposing the cigars to the hot conditions in regular postal service or U.P.S. trucks we sacrifice all of the benefits described above.
We strongly recommend to purchase the cigars in the ORIGINAL box that was packed and sealed at the factory, and ship cross country by AIR not by ground.

All cigars sold by Mike's Cigars are not meant for resale purposes. The Site is intended for users who are at least 21 years old, and are allowed, by law, to purchase Tobacco products in the state in which the user resides.
AGE RESTRICTIONS
Persons under the age of 21 are not permitted to use or register for the Site.
A user’s age is verified and confirmed upon purchase of products on our site. Merchandise to underage customers will not be shipped.
We adhere to all Federal & State restrictions on Tobacco Sales, including minimum age of purchase.
Why does Mike’s Cigars require that you verify your age?
As per FDA regulations, we are required to ensure that we do not sell our products to anyone under the age of 21*. In order to verify our customer’s ages, as well as to protect them from fraud, we use a third-party system called Veratad to verify the identification and age of every customer that places an order on our site.*In the U.S. the age may vary based on state.
What is Veratad, and how does it work?
Veratad uses a database comprised of billions of public records to validate the information you submit when placing an order, to confirm the identity and age entered into our system. This service is designed to do this without sacrificing the privacy of the customer when placing an order.
Veratad is renowned for preventing cases of identity fraud by utilizing historical information that cannot be gleaned by the methods typically employed by identity thieves.
What does Veratad do with the information they obtain and is it secure?

What happens if I do not pass the Veratad verification process?
A small percentage of customers fail the verification process, usually due to limitations in the age verification database, or due to the customer being located outside of the USA. In these instances, we will contact you to verify your identity or age manually. To do so we will require a copy of your driver’s license, or other government-issued ID, to verify your identification.
What if I enter the wrong date of birth, so that I can place an order for cigars?
If we receive an order from someone that entered a date of birth that is not verified by VERATAD, we will require the customer to send proof of their D.O.B. If the customer fails to comply, a cancellation fee will apply.
SALES TAX
Items sold by Mike’s Cigars and its subsidiaries may be subject to state and local taxes when they are purchased and/or shipped to select locations in the United States and it’s territories.
We adhere to all Federal & State restrictions on Tobacco Sales, including online taxes in the areas in which they would apply. Taxes, as they are displayed on Mike’s Cigars, are a combined rate that will include relevant State, County, & City Tax Rates as they apply.
Tax rates are based on the delivery address, not the billing address, and may vary due to the type of items being purchased.
EXCISE TAX
Ohio
As of October 2019, the state of Ohio imposes an excise tax on all tobacco products shipped into the state. Please note this excise tax is in addition to the OH sales tax already imposed on tobacco products sold to OH customers. For more details on the OH Excise Tax, review the Ohio Code 5743.62.
Maryland
As of July 2020, the state of Maryland imposes an excise tax on all tobacco products shipped into the state. Please note this excise tax is in addition to the MD sales tax already imposed on tobacco products sold to MD customers. For more details on the MD Excise Tax, review the Maryland House Bill 1301.
South Dakota
As of January 2022, the state of South Dakota imposes an excise tax on all tobacco products shipped into the state. Please note this excise tax is in addition to the SD sales tax already imposed on tobacco products sold to SD customers. For more details on the SD Excise Tax, review the 2021 South Dakota Legislature House Bill 1098.
North Carolina
As of July 2022, the State of North Carolina imposes an excise tax on all tobacco products shipped into the state. Please note this excise tax is in addition to the NC sales tax already imposed on tobacco products sold to NC customers. Cigars are taxed at 12.80% of the wholesale price, with a maximum excise tax of thirty cents ($.30) per cigar. For more details on the NC Excise Tax, review the North Carolina Session Law 2021-180.
Michigan
The State of Michigan imposes an excise tax on all tobacco products shipped into the state. Please note this excise tax is in addition to the MI sales tax already imposed on tobacco products sold to MI customers. Cigars are taxed at 32% of the wholesale price, with a maximum excise tax of fifty cents ($.50) per cigar. For more details on the MI Excise Tax, review the Michigan Legislature Section 205-431.
Indiana
As of February 2024, the state of Indiana imposes an excise tax on all tobacco products shipped into the state. Please note this excise tax is in addition to the Indiana Sales Tax already imposed on tobacco products sold to Indiana customers. Colorado
As of March 2024, the state of Colorado imposes an excise tax on all tobacco products shipped into the state. Please note this excise tax is in addition to the Colorado Sales Tax already imposed on tobacco products sold to Colorado customers. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

20. Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Site.
21. Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”).
22. Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software.
23. Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site.
24. Use the Site in a manner inconsistent with any applicable laws or regulations.
FOREIGN CREDIT CARDS
We do not accept foreign credit cards. Customer checkout must be with a U.S. based credit card, with a domestic billing address or via PayPal. Any order made with a foreign credit card will be subject to cancelation and a 4% cancelation fee.
GIFT CARDS
Your order may be placed on hold if you do not follow the correct procedure regarding activating and registering Gift Cards (Visa, MC, Amex, etc.)
Think of a gift card as a temporary bank account. When you open a checking account at the bank for example, the bank gives you an account number and a debit card that allows you to spend the money in that account. Gift cards work similarly. When you buy a gift card, the gift card issuer creates a temporary account to hold the funds deposited, and you hold the plastic gift card or egift card in order to use those funds. If you don’t activate the gift card, payment transactions may be declined because the temporary bank account is not ready, or is not linked to the card number you have. If you walk into a store with that gift card, there is no problem with it since it is a "card present" transaction, but if you are attempting to use it online, that transaction is not secure since the CVV renders an ambigious result, as the card was not previously activated proprely. Such transaction will confuse the vendor, and the fraud prevention department is likely to hold the order for further security verification.
How to avoid issues with a gift card when purchasing online? There are two simple steps involved:
Activate: If you purchased your gift card from a retail outlet, the card should be activated and ready for immediate use after purchase, however, that is not always the case, due to the increasingly amount of fraud comminted with these types of cards. If you purchased it online, you’ll definitely need to activate it once you receive it. This is typically done online or by calling the toll-free number listed on the card.
Register: You’ll also need to register your card if you want to use it online, so that retailers can link the card to a billing address. Instructions on how to do this will be provided with the card. The process usually requires entering the card information online or by phone as well as your name, billing address and phone number. This will allow you to use a billing address when checking out during an online transaction, giving the vendor an opportunity to verify.

All shipments from Mike's Cigars are FOB Origin Bay Harbor Islands, FL.
Title to, and ownership of all goods passes from Seller to Purchaser in Bay Harbor Island, Florida. Purchaser takes full responsibility for the shipment. By selecting the shipping method of transportation of the goods, Seller is providing a service to, and acting on behalf of Purchaser.
By accepting this service from Seller, Purchaser is affirming that they are acting in compliance with their local and state laws regarding the purchase, transportation, and delivery of the goods. The Purchaser affirms that they are of lawful age, have obtained all permissions required, paid all fees required, and are working through properly licensed intermediaries where required, as well as are legally entitled to take possession of the goods and quantities ordered.
TERM AND TERMINATION
These Terms of Use shall remain in full force and effect while you use the Site.
